Verte Collaborative Agreement
Purpose
This Agreement is between you (“Client”) and Verte Collaborative (“Coaches”) for purposes of entering into a coaching relationship and participating in the Program (“Program”). It sets out the terms and conditions under which the parties will work together.
Effective Time of Agreement
The Agreement shall take effect when the Client has both checked the box on the Registration page, indicating agreement with these terms and conditions, and completed payment.
Philosophy
The Program and coaching are collaborative processes. Together we will gain clarity on your values and priorities, we will build new awareness and increase your emotional intelligence. We will work together to build capacity for curiosity, reflection, and resilience. This coaching program brings you together with sustainability professionals and is designed to support your growth and development.
The Program and coaching are not mentoring, consulting or therapy, nor are they substitutes for therapy. Our coaching philosophy honors the premise that group members are competent, capable and creative. Our role as Coaches is not to have all the answers or tell you what actions to take. Our role as Coaches is to facilitate a process that will create awareness, deepen your learning and forward your action.
The Program and coaching are confidential. Coaches are committed to maintaining a safe and courageous space, free of judgment, where everything discussed will be held in confidence. The only exceptions to this would be scenarios in which (1) the Coaches reasonably believe there is an imminent danger to the Client’s physical being or the physical being of others, or (2) the Coach receives a court-ordered subpoena for information, as the coach-client relationship is not privileged under any federal or state law.
Record Retention
Coaches may take notes during sessions. Any notes, assessment results, activities or other documents accumulated throughout the duration of the Program will be retained by Coaches for no less than six months following the end of the Program. Records disposal will be done in a manner that protects confidentiality of Client information.
Coaching Sessions and Fees
The Program details (such as number of group and individual coaching sessions, program duration, group session dates, and cost) are included supplemental program documentation.
The Program will be conducted via Zoom. By participating, you agree sessions may be recorded for group member access only (recordings are not to be shared beyond group participants).
Client may also participate in three individual coaching sessions via Zoom or phone. The Client will be assigned the same Coach for all 3 sessions. Session dates will be scheduled between the Client and their assigned Coach. All individual coaching sessions must be completed within 60 days of the final group coaching session.
Total cost for each program is listed on the Registration Page (for the most up-to-date Program costs, please see www.vertecollaborativeprograms.com). Payment methods will be detailed in the Welcome packet for each program. A $50.00 deposit is due upon acceptance into the program and the remainder of the Program fee is due by midnight the day before the first group coaching session. Coaches may, at their discretion, extend deadlines or make other payment arrangements.
Cancellation Policy
Client is welcome to reschedule individual coaching sessions if they provide at least 24 hours’ notice. Rescheduling is subject to assigned Coach’s availability.
Refund Policy
Client may leave the Program at any time. If Client decides to leave prior to joining the first group coaching session, Client may request the $50 deposit be returned. Please email us at vertecollaborative@gmail.com to request a refund. No other refunds shall be given, except in extenuating circumstances.
Feedback from Client
Client acknowledges in an effort to continuously improve the Program, written feedback will be solicited via anonymous surveys. Feedback is welcome and can be given directly to the Coaches throughout the program.
License to use Media or Program
Unless otherwise stated, Coaches own the intellectual property rights to the Program.
Client may view, download, and print pages from the Program for Client’s own personal use only.
Client shall not:
republish material from the Program,
sell, rent or sub-license material from the Program,
reproduce, duplicate, copy or otherwise use material from the Program for a commercial purpose
edit or otherwise modify any material on the Program; or
redistribute material from the Program except for content specifically and expressly made available for redistribution.
Privacy Policy
The Program and Coaches collect the following personal data from you: name, address, email address, phone number, organization, and role/title. The Coaches will never share this information with third parties with the exception of other group members as outlined below. Your personal data will be kept in a password-protected private folder shared only between the facilitating coaches. Enrolling in the Program automatically entitles you to Verte Collaborative periodic e-updates and emails from our associate Coaches. Your personal data shall be kept for six months following the conclusion of the Program, and may be kept up to three years. At that time, your data will be removed from all Coaches’ electronic and paper records. Following the Program’s conclusion, you may unsubscribe from the Program’s electronic communication at any time.
Client understands and agrees that Coaches may share Client’s name, organization and location (city, state, country) with other group members. Client also understands and agrees that because Zoom sessions are recorded and shared with group members, Client’s face and voice will be recorded and shared.
Client understands and agrees that Coaches and Program may also collect user content from you when you provide it to them. If you choose to comment or post during the Program, you are choosing to disclose any personal data included in such content.
Disclaimer
Client understands that Coaches are not mental health professionals. The information presented in the Program is educational only and does not constitute medical or counseling advice. Any decisions or actions taken by the Client as a result of the Program or coaching sessions are the sole responsibility of the Client.
Client understands that Coaches have not and do not make any representations about the results Client may achieve through participation in the Program and individual coaching.
Warranties and Limited Liability
Except as expressly provided in this agreement, the Coaches make no guarantees, representations or warranties of any kind or nature, express or implied with respect to the services negotiated, agreed upon and rendered. In no event shall the Coaches be liable to the Client for any indirect, consequential or special damages. Notwithstanding any damages that the Client may incur, the Coaches’ entire liability under this agreement and the Client’s exclusive remedy, shall be limited to the amount actually paid by the Client to the Coaches under this agreement.
Law and jurisdiction
This Agreement is governed by and construed in accordance with Wisconsin law. In any legal proceeding, Client agrees to the personal and subject matter jurisdiction of Wisconsin courts.
Entire agreement
This document reflects the entire agreement between the Coaches and the Client and reflects a complete understanding of the parties with respect to the subject matter. This Agreement supersedes all prior written and oral representations.
By enrolling in this program Client agrees to the above terms and understands that this is a legally binding contract.
